By signing this agreement, you consent and agree to:

  1. I/We hereby apply for a Construction Certificate (CC); Complying Development Certificate (CDC); Occupation Certificate (OC) or any other application or modification required or related to this development.
  2. We consent to the principal certifier (PC), or an accredited certifier, or consent authority, entering the subject property at any reasonable time for mandatory critical stage inspections.
  3. Where a Complying Development application requires neighbour notification under the EP&A Regulation 2021, I/we agree to allow KMH Certifiers to notify neighbouring properties with the applicant details and notification plan.
  4. I/We acknowledge that I/we must comply with all relevant DA or CDC conditions and/or pre-conditions prior to works commencing.
  5. I/We advise that building works have not commenced, and will not commence, until 2 days after the Appointment of PC and Notice of Commencement have been provided to Council.
  6. I/We declare that all the information provided is true and correct.
  7. I/We agree to receive approval documentation via electronic communication.
  8. I/We have freely chosen to engage KMH Certifiers (Karl Harb BDC04771).
  9. I/We have read KMH Certifier's Fee Proposal and Contract for Certification Work and understand the role and responsibilities of each party.
  10. I/We consent and provide permission to KMH Certifiers to update any discrepancies in the NSW Planning Portal.
  11. I/We agree to the execution of the Contract.
  12. By signing this agreement electronically, I/we agree to be legally bound by the terms of this agreement.

Development Consent (DA/CDC) & Construction Certificate (CC) Details

Details of the Applicant/s

An application for an Occupation Certificate may only be made by a person who is eligible to appoint a Principal Certifier for the development. An application may not be made by a person who will carry out the building work unless that person owns the land on which the work is to be carried out.

  2. We consent to the principal certifier (PC), or an accredited certifier, or consent authority, entering the subject property at any reasonable time for mandatory critical stage inspections.
  3. I/We acknowledge that I/we must comply with all relevant DA or CDC conditions and/or occupation certificate conditions nominated in the approval documentation.
  4. I/We declare that all the information provided is true and correct.
  5. I/We agree to receive approval documentation via electronic communication. Hard copy approval documentation can be provided on request.
  6. I/We have freely chosen to engage KMH Certifiers (Karl Harb BDC04771).
  7. I/We consent and provide permission to KMH Certifiers to update any discrepancies in the NSW Planning Portal.
  8. By signing this agreement electronically, I/we agree to be legally bound by the terms of this agreement.

Owners consent & Principal Certifier declaration

This section must be signed and consented to by all registered owner(s) of the property. By signing this agreement, you consent and agree to:

  1. I/we have freely chosen to engage Karl Harb BDC04771 as the Principal Certifier for the proposed development.
  2. I/We have read and accept the conditions outlined in the building and Development Certification Service Agreement and understand that this document forms the basis of the Certification Contract.
  3. I/We understand the roles and responsibilities of the Owner and the Registered Certifier.
  4. I/We confirm that we have read and understood the accompanying Fee Proposal, Contract and that you understand your rights and responsibilities and those of the Certifier.
  5. I/We confirm that we have read the accompanying prescribed information sheet issued by Fair Trading.
  6. I/We give consent to KMH Certifiers to update any discrepancies in the NSW Planning Portal with respect to this application.
All registered owners of the property have read and agree to the six points above.
